1. About Listiqa

Listiqa ("we", "our", "the Platform") is a property negotiation platform that enables buyers and sellers to connect, submit offers, negotiate terms, and manage property transactions digitally. Listiqa is not a licensed real estate agent, broker, or financial advisor.

2. Acceptance of Terms

By creating an account or using the Platform, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Platform.

3. User Accounts

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must be at least 18 years of age to use the Platform.

4. Identity Verification

Users may be required to complete an identity verification process before listing properties or making offers. By submitting verification documents, you confirm they are genuine and belong to you. We reserve the right to reject or revoke verification at our discretion.

5. Property Listings

Sellers are solely responsible for the accuracy of their listing information, including property details, images, pricing, and disclosures. Listiqa does not verify the accuracy of listings and is not liable for misrepresentation by sellers.

6. Offers and Negotiations

Offers submitted through the Platform are expressions of interest and records of agreed terms between parties. They do not constitute legally binding contracts for the sale of property unless a formal Contract of Sale has been executed in accordance with applicable state or territory laws.

Both parties are strongly advised to seek independent legal advice before entering into any property transaction.

7. Auctions

Online auctions conducted through the Platform are facilitated as a digital bidding mechanism. Listiqa does not act as a licensed auctioneer. All auctions are subject to any reserve prices set by the seller. Bids placed are non-binding expressions of interest unless a formal contract is subsequently executed.

8. Contracts and Signatures

The Platform provides digital terms sheets and signature functionality as a record of agreed terms. These are not a substitute for a formal Contract of Sale prepared by a licensed conveyancer or solicitor. Both parties should engage qualified legal professionals before finalising any property transaction.

9. Off-Market Offers and Owner Outreach

Users may submit offers on properties not listed on the Platform. If a user elects to use our owner outreach service, they acknowledge that:

  • A fee may apply for property data lookup and direct mail services
  • Fees are non-refundable regardless of whether the owner responds
  • Listiqa does not guarantee the accuracy of property ownership data
  • Listiqa does not guarantee delivery of correspondence or any response from the owner

10. Fees and Payments

Certain features of the Platform may incur fees, which will be clearly disclosed before any charges are applied. All fees are in Australian Dollars (AUD) unless otherwise stated.

11. Limitation of Liability

Listiqa is a technology platform that facilitates connections between buyers and sellers. To the maximum extent permitted by law:

  • We do not provide legal, financial, or real estate advice
  • We are not responsible for the outcome of any negotiation or transaction
  • We are not liable for losses arising from use of the Platform
  • We do not guarantee the accuracy of any information provided by users
  • We are not a party to any property transaction conducted through the Platform

12. Prohibited Conduct

Users must not:

  • Provide false or misleading information in listings, offers, or verification
  • Use the Platform for fraudulent or unlawful purposes
  • Interfere with or disrupt the Platform's operation
  • Attempt to access other users' accounts or data
  • Submit fictitious offers or engage in dummy bidding

13. Termination

We may suspend or terminate your account at any time if we believe you have violated these Terms, engaged in fraudulent activity, or for any other reason at our discretion.

14. Governing Law

These Terms are governed by the laws of the State of Victoria, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Victoria.

15. Changes to Terms

We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
